If the User does not agree, they must immediately stop using the Platform.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Use of the Platform is also contingent upon adherence to the Privacy Policy and the Cookie Policy, which are integral and inseparable complementary documents to this agreement.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Regarding the processing of personal data, the specific provisions of the Privacy Policy and the Cookie Policy shall prevail.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">These Terms apply to all Platform Users, but certain specific provisions will apply exclusively to Clients who subscribe to paid services, advanced reports, or other products made available by the Platform, the conditions for which are incorporated into these clauses.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p>\u00b9 The Green Bridge Facility (GBF) is a project incubated under the Igarap\u00e9 Institute (CNPJ 14.051.935\/0001-01), and is responsible for the technical and operational management of the KYT-e Platform.<\/p><p>\u00a0<\/p><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c45920e elementor-widget elementor-widget-heading\" data-id=\"c45920e\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">1. Definitions\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dbd441f elementor-widget elementor-widget-text-editor\" data-id=\"dbd441f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>1.1.<\/b><span style=\"font-weight: 400;\"> For the purposes of these Terms, the following definitions shall apply:<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Green Bridge Facility \u2013 GBF<\/b><span style=\"font-weight: 400;\">\u201d: A project incubated and managed by the Igarap\u00e9 Institute, which is responsible for the Platform&#8217;s technical and operational management.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>KYT-e Platform<\/b><span style=\"font-weight: 400;\">\u201d or \u201c<\/span><b>Service<\/b><span style=\"font-weight: 400;\">\u201d: A digital system developed by GBF, designed for collecting, analyzing, and presenting territorial and socio-environmental information.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>User<\/b><span style=\"font-weight: 400;\">\u201d: Natural person accessing or using the KYT-e Platform, in any of its forms (free or paid).<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Client<\/b><span style=\"font-weight: 400;\">\u201d: An individual or legal entity that purchases paid services from the Platform, including, but not limited to: premium modules, advanced reports, specialized exports, or any other available products. The purchase may occur electronically (e.g., digital form, order form) or through another instrument specified by GBF.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Order Form<\/b><span style=\"font-weight: 400;\">\u201d: A document (digital or electronic) that formalizes the hiring of paid services made available by the Platform, specifying the scope, fees, term, and other conditions, and forming an integral part of these Terms of Use and Service.<\/span><\/p><p><br \/><span style=\"font-weight: 400;\">\u201c<\/span><b>Access Account<\/b><span style=\"font-weight: 400;\">\u201d: Individual credentials consisting of a login (email) and password, provided by the User during registration, intended to enable authentication and use of the Platform. <\/span><br \/><br \/><\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>User Content<\/b><span style=\"font-weight: 400;\">\u201d: Any data, information, text, comments, interactions, or files voluntarily entered or shared by the User on the Platform, including, but not limited to, questions and interactions with the artificial intelligence assistant.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Reports<\/b><span style=\"font-weight: 400;\">\u201d: Documents, dashboards, or exports generated by the Platform, based on proprietary and\/or public data, which do not replace complete technical reports or professional advice (legal, financial, or environmental), and are for the User\/Client&#8217;s internal use only.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Personal Data<\/b><span style=\"font-weight: 400;\">\u201d: Information related to the identified or identifiable natural person, as defined by the General Data Protection Law (Law No. 13,709\/2018 \u2013 LGPD).<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Privacy Policy<\/b><span style=\"font-weight: 400;\">\u201d: Document that governs the processing of Personal Data carried out within the Platform.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b>Cookie Policy<\/b><span style=\"font-weight: 400;\">\u201d: Document that regulates the use of Cookies and similar technologies on the Platform.<\/span><\/p><p><br \/><span style=\"font-weight: 400;\">\u201c<\/span><b>Data Protection Officer<\/b><span style=\"font-weight: 400;\">\u201d or \u201c<\/span><b>DPO<\/b><span style=\"font-weight: 400;\">\u201d: The person designated by the GBF to act as the channel for communication between data subjects and the National Data Protection Authority (ANPD).<\/span><br \/><br \/><br \/><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-14ad701 elementor-widget elementor-widget-heading\" data-id=\"14ad701\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">2. Object<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-49f8dd0 elementor-widget elementor-widget-text-editor\" data-id=\"49f8dd0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>2.1.<\/b><span style=\"font-weight: 400;\"> The purpose of the KYT-e (Know Your Territory) Platform is to provide Users and Clients with digital resources for consulting, analyzing, and visualizing information on territorial opportunities and risks, utilizing proprietary databases as well as public or third-party data, all processed according to the Know Your Territory (KYT) methodology developed and maintained by GBF.<\/span><\/p><p>\u00a0<\/p><p><b>2.2.<\/b><span style=\"font-weight: 400;\"> The Platform offers:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Free version: basic territorial search features, indicator visualization, and access to interactive dashboards;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Paid\/Premium Version: Additional services, including specialized modules, advanced reports, custom exports, and supplementary features.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>2.3.<\/b><span style=\"font-weight: 400;\"> These Terms govern the use of the Platform in all its current and future forms, including for services that may be added, updated, or discontinued by GBF.<\/span><\/p><p><br \/><b>2.4.<\/b><span style=\"font-weight: 400;\"> The hiring of paid services may occur through an &#8220;Order Form&#8221; or equivalent electronic instrument, which will specify the scope, fees, deadlines, and commercial terms. In the event of a conflict between these Terms and the respective Order Form, the Order Form&#8217;s conditions shall prevail regarding commercial aspects (price, deadlines, scope, and invoicing), and these Terms shall prevail regarding Platform use, intellectual property, liability, and data protection.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f543e55 elementor-widget elementor-widget-heading\" data-id=\"f543e55\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Terms of Use<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9f5df84 elementor-widget elementor-widget-text-editor\" data-id=\"9f5df84\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>3.1. Age Requirements<\/b><\/p><p><span style=\"font-weight: 400;\">The KYT-e Platform is intended exclusively for individuals aged 18 and over. Access by minors is prohibited.<\/span><\/p><p>\u00a0<\/p><p><b>3.2. Registration and Access Account<\/b><\/p><p><span style=\"font-weight: 400;\">To use certain features, the User must create an Access Account, providing true, complete, and up-to-date information.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The Access Account is personal, non-transferable, and the sole responsibility of the User, who must ensure the confidentiality of the information and the proper use of the Service.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The User is solely responsible for the Content they submit, ensuring it does not violate third-party rights or current legislation.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The User is responsible for maintaining the confidentiality of their password and for all activities performed through their account.<\/span><\/p><p>\u00a0<\/p><p><b>3.3. Authorized Use<\/b><\/p><p><span style=\"font-weight: 400;\">The User agrees to use the Platform lawfully, ethically, and in compliance with these Terms, the Privacy Policy, and the Cookie Policy, as well as with current legislation. The following actions are prohibited:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Inserting of false, misleading information, or information that infringes on third-party rights;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Using the Platform for illegal, abusive, fraudulent purposes, or in a way that could harm GBF or other Users;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Attempting to access restricted areas of the Platform, systems, or servers without authorization;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Entering any sensitive personal data or third-party data into the AI chat or free text fields, which violates the Privacy Policy;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Circumventing technical limitations or usage quotas, performing automated scraping, massive data mining, load testing, or unauthorized scanning without prior written permission from GBF;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Interfering with the Platform&#8217;s operation, including through bots, scripts, or undocumented integrations, or using third-party APIs in violation of their terms.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>3.4. Account Suspension and Termination<\/b><\/p><p><span style=\"font-weight: 400;\">GBF reserves the right to suspend or terminate accounts that violate these Terms, the Privacy Policy, or applicable laws, without prejudice to any legal action that may be taken.<\/span><\/p><p>\u00a0<\/p><p><b>3.5. Platform Updates<\/b><\/p><p><span style=\"font-weight: 400;\">The Platform may be updated, modified, or discontinued, in whole or in part, at any time, with reasonable prior notice to Users when significant changes are involved.<\/span><\/p><p>\u00a0<\/p><p><b>3.6. Paid Services and Hiring<\/b><\/p><p><span style=\"font-weight: 400;\">Certain features, premium modules, custom exports, and advanced reports will be available upon subscription. Upon completing the hiring process (e.g., by electronically accepting the digital form or signing the Order Form), the Client acknowledges the scope, pricing, timelines, and conditions set forth therein, which then become part of these Terms.<\/span><\/p><p>\u00a0<\/p><p><b>3.7. Billing, payment, and taxes<\/b><\/p><p><span style=\"font-weight: 400;\">Fees for paid services will be invoiced according to the format and deadlines specified in the Order Form, plus applicable taxes. Failure to pay authorizes suspension of access to the contracted features after prior notice and grants GBF the right to terminate in the event of continued non-payment, without prejudice to the collection of overdue amounts. Unless otherwise specified in the Order Form or by law, paid amounts are non-refundable.<\/span><\/p><p>\u00a0<\/p><p><b>3.8. Cancellation and Termination by the Client<\/b><\/p><p><span style=\"font-weight: 400;\">The Client may cancel paid services at any time by providing notice through the channel indicated in the Order Form. Cancellation takes effect for the subsequent billing cycle, with no refund for periods already started, unless otherwise specified in the Order Form or required by law.<\/span><\/p><p>\u00a0<\/p><p><b>3.9. Report delivery and deadlines<\/b><\/p><p><span style=\"font-weight: 400;\">The deadlines and deliverables for reports and exports will be specified in the Order Form. Delivery may depend on third-party databases and external factors, in which case GBF will make its best efforts to mitigate impacts, without guaranteeing a specific completion time.<\/span><\/p><p>\u00a0<\/p><p><b>3.10. Support<\/b><\/p><p><span style=\"font-weight: 400;\">Operational support will be provided through the official channels indicated on the Platform or in the Order Form. Unless expressly stated otherwise, there is no binding Service Level Agreement; the best-efforts standard applies.<\/span><\/p><p>\u00a0<\/p><p><b>3.11. Communication<\/b><\/p><p><span style=\"font-weight: 400;\">Sending newsletters, institutional communications, or marketing materials to the User will require express consent (&#8220;opt-in&#8221;), which can be revoked at any time, as stipulated by applicable law. Failure to provide or the revocation of this consent will not affect the use of the Platform&#8217;s basic functionalities.<\/span><\/p><p>\u00a0<\/p><p><b>3.12. Account inactivity<\/b><\/p><p><span style=\"font-weight: 400;\">Accounts inactive for 12 months may be deactivated with prior notice sent to the registered email address. Data linked to the inactive account will be handled in accordance with the Privacy Policy and the provisions of Article 16 of the LGPD.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5149207 elementor-widget elementor-widget-heading\" data-id=\"5149207\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4. Obligations of the Parties<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aad186c elementor-widget elementor-widget-text-editor\" data-id=\"aad186c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>4.1. User Obligations<\/b><\/p><p><span style=\"font-weight: 400;\">The User agrees to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Use the KYT-e Platform in compliance with these Terms, applicable law, and good faith;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Provide true, complete, and up-to-date information in their registration and in any communications made through the Platform;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Maintain the confidentiality of their access credentials and be fully responsible for all activities conducted through their Account;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Refrain from entering sensitive personal information, third-party data without authorization, or any content that is illegal, defamatory, discriminatory, obscene, or infringes on the rights of others into the Platform, especially in free-text fields or the AI chat;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Not engage in activities that compromise the security of the Platform, such as reverse engineering, hacking, spreading viruses, or attempting unauthorized access to servers and systems;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make timely payments of contracted amounts, where applicable, and use reports and exports solely for internal purposes, with resale, republication, or distribution to third parties prohibited without express written authorization from GBF;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Credit the source when citing information obtained through the KYT-e Platform in articles, publications, and reports;\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Not use the information generated on the KYT-e Platform out of context to avoid the possibility of misinterpretation.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>4.2. GBF Obligations<\/b><\/p><p><span style=\"font-weight: 400;\">GBF agrees to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make the KYT-e Platform available as described in these Terms, ensuring reasonable levels of availability, continuity, and security;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Implement appropriate technical and organizational measures to protect Users&#8217; Personal Data, in compliance with the Privacy Policy and applicable legislation;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Notify Users of any relevant changes to these Terms, the Privacy Policy, or the Cookie Policy with reasonable advance notice, except in urgent situations;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Respect the rights of personal data subjects, as stipulated in the General Data Protection Law;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make every effort to correct any technical, operational, or security flaws on the Platform as soon as they are identified;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Provide the paid services according to the contracted scope and issue the relevant tax documentation, with the possibility of altering or discontinuing modules upon reasonable prior notice, without prejudice to deliverables already contracted.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d3ff4c5 elementor-widget elementor-widget-heading\" data-id=\"d3ff4c5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Intellectual Property<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8e9bbfe elementor-widget elementor-widget-text-editor\" data-id=\"8e9bbfe\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>5.1. Copyright and Property Rights<\/b><\/p><p><span style=\"font-weight: 400;\">All intellectual property rights related to the KYT-e Platform, including, but not limited to: software, code, methodologies, reports, dashboards, databases, interfaces, logos, trademarks, technical materials, texts, images, maps, scores, audio, video, and other available content, belong exclusively to GBF, or to third parties who have licensed such rights to them.<\/span><\/p><p>\u00a0<\/p><p><b>5.2. Know Your Territory (KYT) Methodology<\/b><\/p><p><span style=\"font-weight: 400;\">The KYT methodology, its concepts, analyses, indicators, and presentation formats are the intellectual property of GBF. The User acknowledges that using the Platform does not grant them any rights to the methodology; they are only granted a limited, non-exclusive, non-transferable, and revocable license to use it, restricted to the purpose stated in these Terms.<\/span><\/p><p>\u00a0<\/p><p><b>5.3. Reports and Exported Content<\/b><\/p><p><span style=\"font-weight: 400;\">Reports generated and exported by the Platform are exclusively for the internal use of the User or their organization, within the scope of the granted license. Reproduction, publication, distribution, sale, reverse engineering, translation, modification, or the creation of derivative works are prohibited without prior express authorization from GBF.<\/span><\/p><p>\u00a0<\/p><p><b>5.4. Misuse<\/b><\/p><p><span style=\"font-weight: 400;\">Unauthorized use of any intellectual property rights related to the Platform may result in civil, administrative, and criminal liability, according to applicable law, including the Copyright Law (Law No. 9,610\/1998) and the Industrial Property Law (Law No. 9,279\/1996).<\/span><\/p><p>\u00a0<\/p><p><b>5.5. Distinguishing Features<\/b><\/p><p><span style=\"font-weight: 400;\">The name \u201cKnow Your Territory\u201d, the acronym \u201cKYT-e\u201d, and the associated logos, trademarks, and distinctive signs are owned by GBF and are protected by applicable law. User access is restricted to identifying the Platform; any improper use or use that causes confusion or incorrect association with third parties is prohibited.<\/span><\/p><p>\u00a0<\/p><p><b>5.6. Feedback<\/b><\/p><p><span style=\"font-weight: 400;\">By submitting suggestions, ideas, or recommendations regarding the Platform, the User grants GBF a non-exclusive, royalty-free, irrevocable, and perpetual license to use, incorporate, and exploit such contributions without any requirement for attribution or payment.<\/span><\/p><p>\u00a0<\/p><p><b>5.7. Aggregated data and improvements<\/b><\/p><p><span style=\"font-weight: 400;\">GBF may use aggregated and anonymized usage data for statistical, security, auditing, and Platform improvement purposes, in accordance with the Privacy Policy.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2f9fa5b elementor-widget elementor-widget-heading\" data-id=\"2f9fa5b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">6. Responsibilities of the Parties<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-215e196 elementor-widget elementor-widget-text-editor\" data-id=\"215e196\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>6.1. User Responsibility<\/b><\/p><p><span style=\"font-weight: 400;\">The User is solely responsible for:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The truthfulness, integrity, and up-to-date nature of the information provided during registration and use of the Platform;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The proper use of the Platform, respecting the legitimate purposes set forth in these Terms;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Any direct or indirect damages caused to themselves, third parties, or GBF resulting from improper or unlawful use of the Platform;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The confidentiality of their login credentials, which must not be shared with third parties.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>6.2. GBF Responsibility<\/b><\/p><p><span style=\"font-weight: 400;\">GBF commits to providing the Platform with reasonable levels of security, stability, and functionality, making every effort to keep it updated and accurate. However, it does not guarantee that its operation will be uninterrupted, free of faults, vulnerabilities, or errors, especially due to factors beyond its control (unforeseen circumstances, force majeure, failures in telecommunication networks or external providers).<\/span><\/p><p>\u00a0<\/p><p><b>6.3. Disclaimers<\/b><\/p><p><span style=\"font-weight: 400;\">GBF is not responsible for:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Decisions made solely based on the reports, dashboards, analyses, or information obtained from the Platform, which are for informational purposes only;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Content entered by the User in free-text fields or in the artificial intelligence chat, even if it contains personal data or sensitive information;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Losses resulting from failures by third parties, such as internet service providers, hosting services, or external APIs;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Links or third-party content that may be available on the Platform, which follow their own policies.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>6.4. Limitation of Liability<\/b><\/p><p><span style=\"font-weight: 400;\">To the maximum extent permitted by applicable law, GBF&#8217;s liability for any proven direct damages is limited to the amount actually paid by the User for using the paid\/premium version of the Platform in the 12 (twelve) months preceding the damaging event. Under no circumstances will it be liable for lost profits, indirect, incidental, or consequential damages.<\/span><\/p><p>\u00a0<\/p><p><b>6.5. Compensation<\/b><\/p><p><span style=\"font-weight: 400;\">The User\/Client will indemnify and hold GBF harmless from third-party claims, losses, and expenses (including any attorney&#8217;s fees) resulting from:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Improper or illegal use of the Platform;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Violation of these Terms;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">User content that infringes on third-party rights or the law; or<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Failure to comply with legal obligations incumbent upon them.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-71047d8 elementor-widget elementor-widget-heading\" data-id=\"71047d8\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">7. Disclaimer of Warranties<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c8f79bd elementor-widget elementor-widget-text-editor\" data-id=\"c8f79bd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>7.1.<\/b><span style=\"font-weight: 400;\"> The KYT-e Platform is provided \u201cas is\u201d, without any warranties of any kind, express or implied, including, but not limited to, warranties of performance, merchantability, fitness for a particular purpose, or freedom from defects.<\/span><\/p><p>\u00a0<\/p><p><b>7.2.<\/b><span style=\"font-weight: 400;\"> Furthermore, GBF does not guarantee that the Platform will:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Operate continuously, free from errors, technical failures, or vulnerabilities.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fully meet the User&#8217;s specific expectations or needs;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Be free of viruses, malware, or other harmful elements, even if reasonable security measures are taken to mitigate those risks.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Maintain all currently available features unchanged indefinitely, since these may be altered, suspended, or discontinued as the project evolves technologically and strategically. However, there is no guarantee that the information will be updated, just as there is no guarantee that the risk and opportunity assessment will remain the same over time or due to methodological advancements.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>7.3.<\/b><span style=\"font-weight: 400;\"> The Platform&#8217;s reports, dashboards, and exports provide an overview of the municipality&#8217;s performance at the indicator level and the territorial risk and opportunity level, aggregated according to the KYT methodology. These materials do not replace comprehensive technical reports for identifying and analyzing risks and opportunities, nor do they constitute legal, financial, environmental, or investment advice.<\/span><\/p><p>\u00a0<\/p><p><b>7.4.<\/b><span style=\"font-weight: 400;\"> No information or guidance provided by the Platform, whether through reports, dashboards, or interactions with the artificial intelligence assistant, may be interpreted as a guarantee of results or a commitment from GBF.<\/span><\/p><p>\u00a0<\/p><p><b>7.5.<\/b><span style=\"font-weight: 400;\"> Reports exported through the KYT-e platform provide an overview of the municipality&#8217;s performance at the indicator and opportunity\/risk trend levels for the territory, aggregated according to the Know Your Territory (KYT) methodology. For ventures and investments, the Green Bridge Facility strongly advises conducting a complete KYT analysis and a project-specific risk management plan.<\/span><\/p><p>\u00a0<\/p><p><b>7.6.<\/b><span style=\"font-weight: 400;\"> Interactions with the artificial intelligence assistant are for informational and experimental purposes only, serving solely as support for the User&#8217;s research. Responses do not replace qualified human analysis and should not be used as the sole basis for strategic, legal, financial, or environmental decisions.<\/span><\/p><p><br \/><b>7.7.<\/b><span style=\"font-weight: 400;\"> The Platform will prominently display a permanent notice in its footer and in the AI chat stating that the content and reports provided are for informational purposes only.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cabd506 elementor-widget elementor-widget-heading\" data-id=\"cabd506\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">8. Privacy and Data Protection<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9dd06ba elementor-widget elementor-widget-text-editor\" data-id=\"9dd06ba\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>8.1.<\/b><span style=\"font-weight: 400;\"> The processing of Personal Data carried out by the KYT-e Platform will fully comply with the General Data Protection Law \u2013 LGPD (Law No. 13,709\/2018), the Brazilian Internet Civil Framework (Law No. 12,965\/2014), and other applicable regulations.<\/span><\/p><p>\u00a0<\/p><p><b>8.2.<\/b><span style=\"font-weight: 400;\"> The specific rules regarding the collection, use, storage, sharing, and retention of Personal Data are detailed in the <\/span><a href=\"https:\/\/greenbridgefacility.com\/kyt\/privacy-policy\/\"><span style=\"font-weight: 400;\">KYT-e Platform&#8217;s Privacy Policy<\/span><\/a><span style=\"font-weight: 400;\">, which guides and is an integral part of these Terms.<\/span><\/p><p>\u00a0<\/p><p><b>8.3.<\/b><span style=\"font-weight: 400;\"> The use of cookies and similar technologies is governed by the <\/span><a href=\"https:\/\/greenbridgefacility.com\/kyt\/cookie-policy\/\"><span style=\"font-weight: 400;\">KYT-e Platform&#8217;s Cookie Policy<\/span><\/a><span style=\"font-weight: 400;\">, also an integral part of these Terms.<\/span><\/p><p>\u00a0<\/p><p><b>8.4.<\/b><span style=\"font-weight: 400;\"> The User acknowledges that:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personal data provided or generated through the use of the Platform will be processed according to the purposes described in the Privacy Policy;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They may exercise, at any time, the rights provided for in Article 18 and subsequent articles of the LGPD, by contacting the Data Protection Officer (DPO) indicated in the Privacy Policy;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Any future international data transfer will comply with the legal safeguards outlined in the LGPD, with the User being duly informed.<\/span><\/li><\/ul><p><br \/><b>8.5.<\/b><span style=\"font-weight: 400;\"> In the event of a conflict between the provisions of these Terms and the Privacy Policy, the Privacy Policy shall prevail regarding the Processing of Personal Data.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a2db10d elementor-widget elementor-widget-heading\" data-id=\"a2db10d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">9.
